Welcome to Yazzup. These Terms of Service ("Terms") govern your use of the Yazzup desktop application and related services (collectively, the "Service") provided by Yazzup ("we", "our", or "us"). By using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using Yazzup, you agree to these Terms. If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time, and your continued use of the Service after such updates constitutes acceptance of the revised Terms.

2. Description of Service

Yazzup is a desktop application that helps users manage social media marketing across multiple platforms. The Service includes features such as:

  • AI-powered content generation using third-party AI providers
  • Social media account connection and management
  • Content scheduling and publishing across 50+ platforms
  • Analytics and performance tracking
  • Team collaboration and approval workflows

3. Account Registration

To use certain features of the Service, you may need to create an account. You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorised use of your account
  • Accept responsibility for all activities that occur under your account

4. User Responsibilities

You are solely responsible for the content you create, schedule, and publish using Yazzup. You agree that your content will not:

  • Include spam, malware, or deceptive content

4.2 API Keys and Third-Party Services

When you use your own API keys for AI services or connect third-party accounts:

  • You are responsible for complying with the terms of service of those third-party providers
  • You are responsible for any costs incurred from using third-party APIs
  • You agree to keep your API keys secure and not share them with others
  • We are not liable for any issues arising from your use of third-party services

4.3 Social Media Platforms

You agree to comply with the terms of service, community guidelines, and policies of all social media platforms you connect to Yazzup. We are not responsible for any actions taken by social media platforms against your account as a result of your content or usage patterns.

5. Intellectual Property

5.1 Our Property

The Yazzup application, including its design, code, features, and documentation, is owned by Yazzup and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the application without our written consent.

5.2 Your Content

You retain ownership of the content you create using Yazzup. By using the Service, you grant us a limited, non-exclusive licence to process your content solely for the purpose of providing the Service (e.g., publishing posts to your connected accounts).

5.3 AI-Generated Content

Content generated by AI through Yazzup is subject to the terms of the respective AI provider. You are responsible for reviewing, editing, and ensuring the accuracy and appropriateness of any AI-generated content before publishing it.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using Yazzup, you consent to the data practices described in our Privacy Policy.

7. Acceptable Use

You agree not to use the Service to:

  • Engage in any unlawful, fraudulent, or harmful activity
  • Attempt to gain unauthorised access to any part of the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse-engineer, decompile, or disassemble the application
  • Use the Service for automated mass-messaging or spam campaigns
  • Circumvent any technical restrictions or rate limits
  • Impersonate any person or entity

8. Service Availability

We strive to provide a reliable service, but we do not guarantee that the Service will be available at all times or free from errors. We may:

  • Temporarily suspend the Service for maintenance or updates
  • Modify or discontinue features with reasonable notice
  • Limit certain features based on your subscription plan

We are not liable for any interruptions to the Service caused by factors beyond our control, including third-party platform outages, internet connectivity issues, or force majeure events.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We do not warrant that AI-generated content will be accurate, appropriate, or fit for any particular purpose
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim

10. Indemnification

You agree to indemnify, defend, and hold harmless Yazzup, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your content or its publication on social media platforms
  • Your violation of any rights of a third party

11. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users or to Yazzup. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account data in accordance with our Privacy Policy
  • Provisions that by their nature should survive termination (such as intellectual property, limitation of liability, and indemnification) will continue to apply

You may also stop using the Service at any time by uninstalling the application.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yazzup regarding your use of the Service. They supersede any prior agreements or understandings, whether written or oral.
